Tonewell Tech ("Tonewell Tech", "we", "us") is operated by Ninette Lau Velez. By accessing or using the Tonewell Tech website and editor (the "Service"), you agree to these Terms & Conditions ("Terms"). If you do not agree, please do not use the Service.
1. The Service
Tonewell Tech is a browser-based photo editor that provides one-click presets, local adjustments, and step-by-step Lightroom Classic and Photoshop recipes. A free tier is available; Pro features (premium presets, masking, full-resolution exports) require an active Pro subscription or a valid access code.
2. Your account
You may use Tonewell Tech without an account for basic editing. To purchase Pro or redeem a code, you must create an account using a valid email address. You are responsible for keeping your credentials confidential and for all activity under your account. You must be of legal age to enter into a contract in your jurisdiction.
3. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, including processing imagery you do not have the rights to;
- engage in fraud, spam, or abuse;
- infringe anyone's intellectual property or privacy rights;
- upload malware, attempt to probe or scrape the Service, or interfere with its security or operation;
- resell, redistribute, or reverse-engineer the Service or its presets and recipes.
4. Content and image rights
Tonewell Tech processes images locally in your browser whenever possible. You retain all rights to images you edit. You confirm you have the right to edit and process any image you upload. We may remove access for users who repeatedly infringe others' rights.
4a. Copyright complaints and takedown
We respect intellectual property rights. If you believe content processed, distributed, or referenced through the Service infringes your copyright, trademark, or other rights, please send a written notice to us through tonewelltechniques.com including: (a) your contact information; (b) identification of the work claimed to be infringed; (c) identification of the allegedly infringing material and where it can be found; (d) a statement, made in good faith, that the use is not authorized by the rights holder, its agent, or the law; (e) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the rights holder; and (f) your physical or electronic signature. We will respond to valid notices in a reasonable time, may remove or disable access to the material, and may terminate accounts of users who repeatedly infringe.
5. Intellectual property
The Service, its software, presets, written recipes, branding, and documentation are owned by Tonewell Tech and protected by copyright and other laws. You receive a limited, non-exclusive, non-transferable right to use the Service within your active plan. Pro presets and recipes may not be resold or redistributed.
6. Payments, billing, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time via the receipt email Paddle sends you, or at paddle.net.
7. Service availability
We work hard to keep Tonewell Tech available, but the Service is provided "as is" with no guarantee of uninterrupted or error-free performance. We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
8. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination, your right to use Pro features ends; you can still export any in-progress edits already in your browser session.
9. Liability
To the fullest extent permitted by law, our aggregate liability for any claim related to the Service is capped at the fees you paid us in the 12 months prior to the claim. We are not liable for indirect, consequential, or special damages (including lost profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury where prohibited by law.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced on this page. Continued use of the Service after a change means you accept the updated Terms.
11. Third-party trademarks
Adobe®, Lightroom®, Lightroom Classic®, Photoshop®, Camera Raw®, and Adobe Sensei® are trademarks of Adobe Inc. References to these products in our presets, recipes, and marketing copy are descriptive and used in good faith to teach photo-editing techniques. Tonewell Tech is an independent project and is not affiliated with, endorsed by, or sponsored by Adobe Inc. All other product names, logos, and brands are the property of their respective owners.
